反垄断法视角下我国现行烟草专卖制度问题探究-法律专业论文.docx

内容摘要 维护竞争，保护市场公平与效率，制裁限制竞争行为是反垄断法的立法目的。 在其执行和发展过程中，立法者逐渐发现无法禁止一切限制竞争行为，在有些特 殊领域和行业是违背一般经济规律的。所以世界各国普遍做法是规定适用除外制 度或豁免制度来完善反垄断法。适用除外制度的目的是实现社会整体利益，我国 现行烟草专卖制度的基础同样是通过保护和促进国家利益与消费者利益来提升 社会整体福利，与适用除外制度的目的具有一致性。然而烟草行业在专营专卖的 过程中逐步显露出种种缺陷和不足，导致社会各方质疑现行烟草专卖制度是否应 该继续存在，笔者认为更重要的一点是烟草行业可以借助反垄断法的实施来不断 的对自身进行改革和完善。 本文通过详细分析《反垄断法》适用除外制度与现行烟草专卖制度之间关联， 认为该立法是国家对烟草行业当然也包括其他特殊行业的合法垄断认可。《反垄 断法》从出台到付诸实施，引发了社会对现行烟草专卖制度存与废的相关思考， 本文试图从反垄断法视角探究我国现行烟草专卖制度与反垄断法关系，同时对我 国现行烟草专卖制度和烟草行业的改革提出建议。 关键词：反垄断法；烟草行业；专卖制度 Abstract Maintenance of competition, fairness and efficiency, protecting market sanctions restrict competition behavior is antitrust legislation purpose. Lawmakers in the process of its execution and development, gradually found themselves unable to ban all restrict competition behavior, in some special areas and industries will be a breach of general economic laws. The world is so general except approach is provided for system or exemption system to improve the anti-monopoly law. Except for system implementation is the purpose of the interests of the whole society and is also the basis of our current tobacco monopoly system through the protection and promotion of national interests and the interests of the consumers to promote the overall welfare of society and the suitable exception system with the purpose of consistency. However the tobacco industry in the process of exclusive dealing gradually reveals the shortcomings and the insufficiency, leading to social parties to question whether the current tobacco monopoly system should continue to exist, the author thinks that is more important that the tobacco industry can help the implementation of the anti-monopoly law to unceasingly to reform and improve itself.
