内容摘要 在城中村拆迁安置的过程中，农民的宅基地使用权被收回，其上附着的房屋被拆迁， 城中村拆迁安置意味着城中村土地利益的再次分配。 本文首先分析了城中村拆迁安置的意义及拆迁安置的三种模式，并对各自的优缺点 予以较为详尽的论述，表达了作者对这几种模式的担忧。 其次，作者以广州市天河区猎德村的拆迁安置模式作为视角，将其和三种普通模式 作对比，这种以村集体经济组织为收回宅基地使用权主体和拆迁实施主体的城中村拆迁 安置模式在一定范围和一定条件下可供其他地方借鉴学习。但必须尊重当地的实际，并 在拆迁安置过程中予以调整修正。 最后，针对猎德村拆迁安置中所涌现的法律问题，我国目前尚无明确的法定程序和 详尽的实体规则对集体所有土地上的房屋拆迁安置问题加以规范，本文既是结合广州地 区城中村拆迁安置实践的前提下，对城中村拆迁安置中的搬迁纠纷的法律适用予以分 析，并尝试对其救济途径予以构想。应通过制定征收法律，立法确认上级人大及其常委 会对公共利益界定的审查职能，提高城中村村民利益表达的能力和建立和完善城中村拆 迁安置后村民的就业和社会保障制度等路径予以完善。 关键词：猎德；城中村；拆迁安置；涉诉问题 Abstract In the process of the reconstruction of villages within the city, the famers’ right of using the house-based land was confiscated. And the attached houses were pulled down and removed. The reconstruction of villages within the city means the re-distribution of the land interest. This essay analyses the meaning and three modes in the practice of reconstruction of villages within the city first, and argues their advantages and disadvantages in detail, expressing the author’s worry about these modes. Then taking the mode of Liede Village, Tianhe District, Guangzhou as the visual angle, the author contrast it with three common mode. And draw a conclusion that this kind of confiscation of the right by the village collective economic organizations with the whole reconstruction mode is worth learning by other places in a certain range and under the certain condition. However, r we must respect the local realities and correct or adjust it during the reconstruction process. Finally, as for the resettlement issues which emerged in Liede village reconstruction, there is still no clear legal procedures and detailed substantive rules to regulate collectively owned land on the housing resettlement issues in our country. Under the practice of reconstruction of the villages within Guangzhou, this paper analyzes the practical laws of relocation disputes in the reconstruction of villages within the city, and tries to conceive the ways of relief.
