“以营利为目的”与肖像权侵权责任认定 在我国近儿年的肖像权侵权案件中，侵害H像权的加害行为如何认定的闷题一直W扰着当事人 双方及法官。而其屮尤以，是否“以营利为目的”来作力判案标准被长期争论。尽管法律屮明确规 定了肖像权侵权责任认定主要以是否是营利性质来作为判定依据。侃是许多学者并不认同此观点。 本文依据多方面论证，以事实为依据，多角度分析原因，理论联系实际这一思路进行展开论述。 首先阐述相关概念，从理论角度明确区分不同名词所表达的不同含义。继而从宪法精神、生活习惯 以及法律领域三个层面看待“将‘以营利为目的’作为H像权侵权责任构成要件”的不合理、不合 适、不科学性，并以此來证明不应该将“以营利为目的”作力肖像权佼权责任构成要件。最后简述 了 “以营利为0的”界定肖像权侵权责任大小的依据。充分论述了 “以营利为0的”作为肖像权侵 权责任构成要件的不合理性。 关键词肖像权；侵权责任；以营利为目的；责任认定 ’’For-profit’’ and image right infringement responsibility identification Abstract In our image rights infringement cases in recent years，how infringement of portrait rights recognized harm behavior has been plagued by both parties and the judge. And especially in，whether n for profit as the judgment criteria are long debate . Although the law clearly states the portrait tort liability if it is found mainly in the nature of a judgment -profit basis . But many scholars do not agree with this view. In this paper，based on various arguments，fact-based，multi-angle analysis of the reasons，theory and practice are expanded on this idea are discussed . First elaborated concepts，from a theoretical point of view clearly distinguish different meanings expressed in different terms .
