我国医疗纠纷的证据保全制度 摘要 市于医疗纠纷事件的存在比较特殊，要想合理而有效地处理好医 疗纠纷，需要制定一个相对完善的制度政策，另外要保障医疗证据是 完整无误的，以此来促进处理医疗纠纷的过程是安全且有保障的。依 据法律的角度来看，维护法律公平正义就必须使得法律工作者在处理 医疗纠纷的过程中维持医疗机构和患者能够保持平等地位，事实上， 二者相互对立统一，既有互相损害的可能性，也有各自需要实行的权 利和义务。因此，我们需要运用法律手段去维护好双方的权益，在处 理医疗纠纷的过程中，时刻保持公平公正。本文首先从意义上去阐述 如何进行医疗保全及司法鉴定体制的全面性，其次说明医疗纠纷中存 有哪些问题，最后指出针对这些问题应该做出哪些具体措施。 我国医疗改革在不断地进步发展，其中如何保存好病历书等资料 也在逐渐实行规范化、制度化。然而由于目前没有相关法规的制定与 实施，在处理医疗纠纷的过程中并没有法律的支持，这样就导致了患 者不相信官方所列出的证明，证据收集不完整，最后使得司法鉴定也 不能有效的开展开来。由此可见，为了更好的处理好理疗纠纷问题， 需要建立健全体制化的证据保全措施，并在一定程度上加强司法鉴定 保障。 关键词：医疗纠纷；证据判定；证据保全制度； Abstract Because the medical disputes are very special, to reasonably and effectively deal with medical disputes, need to establish a relatively complete system of policies, in addition to ensure medical evidence is correct and complete, in order to promote the process of dealing with medical disputes and the safety is guaranteed.
