摘 摘 要 本文是以现行《中华人民共和国刑法》第一百三十三条规定的交通肇事罪作 为研究对象。全文共分三章，分别对交通肇事罪的适用范围和客观要件、主体和 共犯问题、交通肇事后逃逸等方面的问题进行了研究和探讨，辨析现有交通肇事 罪理论中的一些疑难争议问题。第一章主要论述交通肇事罪是否适用于道路、水 上运输以外的交通运输和在公共交通管理范围外发生的重大交通事故，以及交通 事故责任和赔偿能力作为交通肇事罪构成要件的合理性研究；第二章是探讨非机 动车驾驶人、行人的交通肇事罪主体资格问题，并对交通肇事罪的共犯形态及认 定进行了阐述；第三章从评析交通肇事后逃逸行为的性质和认定出发，重点讨论 “因逃逸致人死亡”的定性和处罚问题。 关键词：交通肇事罪，犯罪构成，共犯，逃逸 ABSTRACTThis ABSTRACT This thesis deals with the traffic delinquent crime as stipulated in Clause 1 33 of The Criminal Law ofThe People’S Republic OfChinat a law currently in effect， It is composed of three chapters，studying and discussing respectively such issues as the applicable scope，the objective elements，the subject(s)，joint offence and escaping from the scene in connection with the traffic delinquent crime，and analyzing as well some difficult and disputed issues in the existing traffic delinquent crime theories．Chapter I mainly elaborates on whether or not the traffic delinquent crime is applicable to the severe traffic accident taking place outside the scope of the public traffic management，and examines the reasonableness of the traffic accident liability and the capacity for damages as the constitutive elements of the traffic delinquent crime，Chapter II looks into the issues of the qualifications of a 11011一motorized vehicle driver or a pedestrian as the subject of the traffic delinquent crime，and expounds on the joint offence forms in the traffic delinquent crime and the accreditation thereof．Lastly on the basis of character and establishment analysis of tile illegal act of escaping from the traffic accident scene，Chapter IIIfocuses on exploring the characterization and punishment of the act of death。causing by escaping from the tramc accident scene． Key Words：traffij delinquent crime、constitutive elements of a crime、joint offence ofa crime、escaping from the scene ofa crime 绪论交通肇事罪，是指违反交通管理运输法规，因而发生重大事故，致人重 绪论 交通肇事罪，是指违反交通管理运输法规，因而发生重大事故，致人重 伤、死亡或者使公私财产遭受重大损失的行为。。交通肇事罪是同常社会生活中 常见多发的犯罪，尤其是我国在改革开放之后，各类交通肇事案件逐年上升， 交通事故发案数、死亡人
