i i 摘 要 在城市商品房价格居高不下的市场背景下,小产权房应运而生,小产权房以其低廉 的价格优势,有着广阔的销售市场。小产权房是在我国土地制度下所产生的一种特有的 社会现象,它的出现既有违反法律和政策的一面,又有符合现实需求的合法合理的一面。 目前,小产权房还处于法律的灰色地带,并无具体规定与之对应,法律不保护它但 又未完全禁止它,虽然官方对其性质界定为违法,但小产权房的合法性和合理性在学界 引起广泛的争议,很多学者和民众认为小产权房的存在是合法合理的,由此也带来了很 多的社会问题,由小产权房问题所引发的我国土地法律制度等一系列法律问题具有一定 的理论研究价值。 小产权房产生的原因是多方面的,根本原因是因为我国法律规定的城乡二元土地 制度,《土地管理法》对集体土地使用权流转的限制性规定是小产权房问题产生的制度 根源,但其规定违反宪法、民法和物权法的规定。本论文论证了将小产权房界定为非法, 并没有充分而正当的理由,法律规定之间存在的漏洞致使小产权房在现有的法律和政策 框架下难以解决。在《土地管理法》对集体土地使用权流转受限问题没有解决之前,小 产权房问题将不能从根本上得到解决,也难以进入政策程序。因此本文从完善法律制度 的角度出发,通过解决我国集体建设用地使用权流转受限的问题,提出对符合规划条件 的小产权房赋予合法地位,同时以小产权房合法化为前提,给出解决小产权房问题的对 策。 关键词:小产权房 集体土地使用权流转 合法化 ii ii Abstract In the city, against the background of high housing prices , small property rights house emerged. Advantage of its low price, small property rights house has a broad sales market in our country. In the land system of our country, small property rights house is a unique social phenomenon . On the one hand, it violates the policy and legal, on the other hand, its meets the real needs of lawful and reasonable. Currently,small property rights house in the legal “gray area”, there is no specific provisions about it. The law does not protect it and not ban on it completely.Although the official considers small property rights house is illegal at present, however,widespread disputes about the validity and rationality of the small property rights house in the educational world are still quite intense. Many scholars and the public believe that the existence of small property rights house is lawful and reasonable, and with brought a lot of social problems. A series of legal regime questions of the land system of our country which is caused by small property rights house have some important fundamentalresearching value.
