⑨ ⑨ 项士学位论走 MASTER’S THESIS 指导决策不科学、行政指导缺乏民主参与、行政指导的监督约束机制不健全等。 第三部分，主要是剖析行政指导存在问题的原因。笔者认为行政指导存在问题 的原因主要在于以下四个方面：一是行政人员对行政指导缺乏正确的认识；二是传 统的依法行政观念的影响；三是“权力文化观念浓厚”与“权利文化观念淡薄”并 存；四是行政人员素质不高。 第四部分，主要是对改善行政指导的对策的探讨。本文从六个方面提出改善行 政指导的对策建议，包括转变行政人员观念，提高行政人员的素质；确立行政指导 的基本原则；完善行政指导的立法；完善行政指导程序；建立健全行政指导的监督 机制；建立健全行政指导责任制度。 关键词：行政指导；权力；行政行为；新型行政管理方式 Ⅱ AbstractAdministrative Abstract Administrative guidance，as a new administrative way,has been gradually given attention and utilized widely after Wjdd War II．It’s the product of the unceasing evolution of market function,government role and administrative pattern undfff many factors correlated,such as the economy,the politics，the administration,the culture and the society．Administrative guidance is a kind of administrative activity that the administrative subjects make the relative persons do the things that the administrative subjects expect and reach the administrative goals through the non-compulsory methods． It is a systematical attempt that tries to seek the balance between the government and the market,and an important performance that tries to attenuate the obligatory administration． At present,administrative guidance has been positively utilized to implement the administration in China,for example，issuing administrative plans,announcing administrative information and fo觚dating instructive methods．It is good for forming the legalized public welfare，coordinating administrative organs and the administrative relative p廿sons．It is also advantageous to strengthen the citizen’s consciousness about the right and duty and promote the transformation of the government’S function．It is more advantageous to improve the traditional relation between the officials and the people，create a bigger space where the officials and the people cooperate and inRke up the legal insufficiency, Howc_cer,the fundamental research about administrative guidance is frail，there are different in some basic problems at prewar,for example，what is administrativ
