中文摘要 本文通过对《礼记·乐记》中记载的“礼”、“乐”、“政”、“刑”四者分别进行 考证，并对其相互之间的关系加以分析，认为礼乐政刑思想的核心就是“礼治”， “礼乐政刑”是“礼治”的具体展开。在分析的过程中，笔者逐渐发现社会价值 观与社会控制手段的变化，或者说不同组合与社会治理的实际效果有一定的联 系。通过这样一种视角，本文对中国“礼治”的发展过程和西方“法治”发展过 程中各自的重要阶段都从价值观和社会控制手段入手进行了简单地梳理，并得出 “礼治”与“法治”发展轨迹中的某些值得关注的特点。最后，本文将“礼乐政 刑思想”与 80 年代后出现的“社会治安综合治理”以及“作为治国之道的综合 治理”的思想进行了比较，明确了各自的差异和值得借鉴的共同之处。同时也从 价值观和社会控制的角度对中国当前的法治建设提出了些许建议。 关键词：礼乐政刑思想、礼治、综合治理 1 Abstract It is discussed in this thesis that the core idea of“Li(proprieties),Yue(Music), Xing(punishment), Zheng(certain administrative aspects of government)is “Lizhi(rule of the rites)”, which is the specifications of the former, by means of studying that four ideas in “Book of Rites·Music” respectively, and analyzing their interrelations. In the process of analysis, changes of social values and social controlling means are gradually realized. In other words, there is some relationship between different combinations and the practical effect of social governing. The thesis generalizes the major stages in the development of both Chinese “rule of rites” and western “rule of law” respectively, in the angle of values and social controlling means, and presents some characteristics worthy of attention in the development of “rule of rites” and “rule of law”. Comparison is made between ideas concerning “the thought of ‘Li,Yue,Xing,Zheng’” and ideas from the late 1980s “Comprehensive control of public security” and “Overall governing of state affairs”. And differences and similarities worth learning between are clear. Finally, through a perspective of social values and controls, construction of present rule of law
