2005年第5期 时代法学 论我国刑法第338条的立法缺陷与完善 以犯罪构成要件为视角 欧阳梓华 (湖南公安高等专科学校，湖南长沙 410006) 摘 要：作为1997年刑法增设的一个罪名，重大环境污染事故罪有诸多理论与实践问题值得探讨。其 主观构成要件、侵犯的客体，等等，多年来学界争议颇多。对上述问题进行深入探讨，有利于正确掌握该罪的 犯罪特点，准确适用刑法。刑法第338条规定的重大环境污染事故罪是结果犯，以行为造成法定严重后果为 行为构成犯罪之必要条件，不利于打击所有污染环境的犯罪行为。为促进环境的可持续发展，建议对该条予 以修改和完善，增加危险犯条款。 关键词：重大环境污染事故罪；构成要件；严格责任；立法缺陷与完善；危险犯 中图分类号：D924 文献标识码：A 文章编号：1672—769X(2005)o5—0065—06 On the Legislative Defect and Perfection of Article 338 of Criminal Law — — From the Visual Angle of the Essential Constitution of Crime Ouyang zihua (Hunan Public Security College，Changsha，Hunan 410006，China) Abstract：The accident crime of great environmental pollution，as a new charge of criminal law in 1997，had a great deal of theories and practice problems to deserve the discussion．For many years， the scholars have not reached the extensive common understanding on these problems， such as the su~ective constitution and infringed object．By probing into above—mentioned problems，help US grasp the crime characteristic of the great environmental pollution，apply criminal law properly，and then promote the sustainable development of the ecological environment．The article 3 3 8 of criminal law stipulates that it is a result crime，regarding the legal serious consequence in behavior as the necessity constitution，which is unfavorable tO attacking all criminal offences of polluting the environment．In order tO promote the sustainable development of the environment，this article should be perfected； therefore，the clause of criminal liabilities should be added． Key words：accident crime of great environmental pollution；essential constitution；rigorous re— sponsibility；defect and perfection of legislation
