StatesruledthatGHG emissionsfel1underthedefinitionof “airpollutant”
accordingtotheCleanAirAct(CAA),。eventhoughtheCourtdecidedinthe
latestconsolidatedcase, irRegulatoryGroup E (hereinafterreferred
toasUtilityAir).thattheCAAdidnotcompelEPAtointerpretGHGemissions
emitted by stationary sourcesasan airpollutantunderthePrevention of
SignificantDeteriorationofAirQuality(PSD)pre—constructionpermitand
TitleV performancepermitoftheCAA.DrivenbytheM assachusettscase,
whichwasnotoverruledbytheUtilityAircase.EPA issueditsEndangerment
andCauseorContribute dingsforGreenhouseGasesunderSection202(a)
oftheCleanAirActfEndangermentFinding),findingthatthemixofsixkinds
oflong—livedanddirectly—emittedGHGemissions,carbondioxide(CO2),methane
fCH4,nitrousoxide 2O),hydro—fluorocarbons(HFCs),per-fluorocarbons(PFCs)
andsulfurhexafluoridefSF6),shouldberegulatedinthattheycanbereasonablly
anticipatedtoendangerbothpublichealthandwelfare.
