中文摘要改革开放以来我国在提高妇女的社会和家庭地位方面已经取得了一 些可喜的变化，在制度安排层面上，我国有关的法律法规在原则上是实现 男女平等，但农村妇女，尤其是“外嫁女”的权益受侵害的现象比较普遍， 影响利益分配的公平和农村的社会政治稳定。本文通过对农村“外嫁女” 权益的横向与纵向比较及真实事例分析，揭示侵害农村外嫁女民事权益的 原因，并主要针对广东珠江三角洲地区的外嫁女民事权益问题提出对策思 考。我国以农户为单位的家庭联产承包责任制对集体成员的资格界定不明 确，不利于保障个人的土地权益，农村妇女往往因婚姻关系变迁而被剥夺 以土地承包权、征地补偿款分配权、宅基地分配权、股份分红权、村集体 福利为主的权益。为了避免传统集体经济产权模糊的不足，广东珠江三角 洲地区率先开始以土地为中心的农村股份合作制改革。这在明晰产权方面 有一定的进步。但是，由于制度创新还处于起步阶段，制度设计还存在一 些不足，股东资格的界定标准存在争议。随着农村经济的快速增长和城市 化的不断发展，广东珠三角地区的农村与农村外嫁女矛盾尤为突出。土地 历来是农民的命根子，但随着农村土地的耕作用途迅速淡化，而宅基地、 征地补偿款和股份分红带来的利益越来越丰厚。在利益的驱动下，同时由 于传统观念的影响，村民委员会或村民会议以民主的名义制定规则限制或 剥夺农村外嫁女的合法权益。由于保障农村外嫁女合法权益的法律法规之 间、中央规定与地方条例之间存在抵触与不协调，农村妇女通过司法渠道 维权的难度很大。本文认为，在农村的利益分配中，要实现真正意义上的 男女平等，需要完善保障农村妇女权益的法律体系;规范村民委员会的行 政行为、有力约束其自由裁量权;让农村妇女权益诉讼司法救济途径更为 畅顺；通过立法和司法手段，协调地方政府、村民自治组织与村民个人三 者的利益关系，确保农村妇女得到平等的利益待遇。关键词：外嫁女；外嫁女民事权益；家庭联产承包责任制；农村股份 合作制；三步走AbstractSince the reform and open policy our country has been enhancing womans society and the home capacity aspect had already obtained someencouraging changes ，in institutional arrangements stratification plane，ourcountry related laws and regulations in principle realize the equality of the sexes，But the rural women, “Outside Married Women”(OMW) particularlythe rights and interests the phenomenon which violates are been quite common, affect the benefit assignment fair and the countryside social politics are stable.
