I I 摘 要 摘 要 《消费者权益保护法》（以下称《消法》）是一部保护消费者权益的专门法，是一部 以消费者概念为核心展开的法律。研究《消法》的适用范围，即是研究消费者主体概念， 研究哪些法律主体属于消费者，对争议主体是否属于消费者提出见解。我国《消法》第 二条没有明确消费者的概念，却规定了消费者概念的内涵：“消费者为生活消费需要购 买、使用商品或者接受服务，其权益受本法保护；本法未作规定的，受其他有关法律、 法规保护。”但该条规定没有对“消费者”“生活需要”、“服务”等概念进行明确界定， 内容过于笼统、模糊，使《消法》的司法适用陷入了困境，对消费者维权产生了严重不 利影响，舆论要求修改《消法》的呼声越来越高。本文在通过对《消法》中消费者概念 分析的基础上，分析消费者概念理论上的缺陷和不足，对知假买假、患者、买房业主、 汽车买主、旅游者、单位、虚拟财产消费群体等消费主体是否适用《消法》进行分析， 提出意见，并对如何完善《消法》的适用范围提出建议，希望对《消法》的完善和消费 者权益的保障有所裨益。 关键词 消费者权益保护法 消费者 生活需要 主体 服务 II II Abstract Abstract The protection of consumers rights and interests is to protect consumers rights and interests of consumers , is a core concept in the law.
