华中科技大学硕士学位论文 华 中 科 技 大 学 硕 士 学 位 论 文 II II Abstract The problems of the rural house based on the collective land have always followed with the historical progress of China’ reform, and linked tightly up with Chinese peoples’ life. Around the years, following the development of the real estate market, the price of houses in a lot of big cities have climbed higher and higher, it makes the rural house based on the collective land attract the social attention. Abolish it or not? This question gradually gets the interested circles’ attention and discussion. With the NPC CPPCC’s beginning, the government announce to check the rural house based on the collective land totally, so this problem gets more and more attention again. Although academic circles had proceeded the research for a long time, because the rural house is not only involving with the problem about the legal system of rural land, also involve with the national policies about new rural communities construction, so, based on the results so far, it also proceeded in the two sides, and it formed the point of “abolish” or “not”. Based on the research result, we find that, if we want to figure out the logical relationship of new rural communities construction, rural land legal system and rural house, and propose the effectively solution, we must analyze the problem based on the primary cause about forming the rights system of rural land and the market trend, only on this basement, we can get more information from analyzing the problem. So this paper wants to solute the problem of the rural house basing on this idea, and make my share for the social stability, rural development and perfecting the system of rule by law.
