“控规 “控规调整”工作研究——以自贡市为例 西南政 西南政法大学硕士学位论文 PAGE PAGE 1 PAGE PAGE 2 内容摘要 《城乡规划法》的颁布实施，从国家法律层面肯定了控制性详细规划的法定地位， 控制性详细规划受到空前重视，是规划管理部门进行规划管理和项目审批的重要依据。 但是，由于城市发展的动态性和市场的不确定性，以及控规编制的局限性，使审批通过 的控规不能适应城市建设发展的需要，“控规调整”的现象频繁发生。“控规调整”是一 把“双刃剑”，涉及到多方面的利益，应辩证的看待“控规调整”的积极作用和消极作 用。正确的“控规调整”是对原有控规不足之处的改良和完善，对于科学进行规划管理 和城市建设工作具有重要意义，但是，不正确的“控规调整”可能会破坏城市规划整体 序列，导致城市发展失衡，损害公众利益。因此，如何规范化“控规调整”工作，消除 或至少是减少其消极影响，使其更好的发挥其积极作用，是城市规划管理工作者探索的 重要方向，也是科学进行城市规划管理的必然要求。 本文通过运用文献研究法和案例研究法，对“控规调整”工作进行了系统研究，通 过大量理论研究，对国内外相关课题研究现状及成果进行了整理，以自贡市为例，对控 规调整产生的原因、调整内容、“控规调整”的程序、存在的问题进行了分析。针对“控 规调整”工作的问题，提出一系列改进的措施和建议。重点对自贡市“控规调整”的发 展历程进行了探索，分析了自贡市“控规调整”的现状及存在问题，最后提出科学严谨 的进行“控规调整”论证、建立健全“控规调整”的规范制度、规范化“控规调整” 程 序、提高规划管理部门决策能力、建立完善信息公开、群众参与制度、建立“控规调整” 的成果管理机制等解决措施和办法， 希望能对完善“控规调整”工作起到帮助，以减 少控规不必要的调整，推动“控规调整”各项工作的进步和优化。 Abstract Since the enactment of ueban rural planning law,the legal status of regulatory planning have been affirmed from the national level. Regulatory planning has received unprecedented attention.It’s the important basis of planning management and project approval for the planning management department.However,the regulatory planning get approval can’t meets the needs of urban construction and development, due to the dynamic of urban development and the uncertainty of market and the limitations of the preparation of regulatory planning.“Regulatory plan adjustment”occurs frequently. “Regulatory plan adjustment” is a “double-edged sword” which related to the interests of various stakeholders.
