Abstract
These days, estate speculation has all the way up to becoming hotter and hotter. Many people, including solaria and other employees, are by no means able to afford the ever-increasing prices of houses with a slim salary. Instead, they have to rent one from those who own two or more houses to solve the housing problem. Yet, as the opposite of the tenants, the renters are more than not the estate speculators in the reality, some of whom, possibly, are forced to let out their houses, trying to avoid the losses by leaving their houses unused when the high prices resulting from the speculation make it difficult to arrive at a successful deal; and some of whom, may have bought these houses just for the rent. Whatever the reason is, the former or the latter, the price charged for the rent is by no means low, in other words, their purposes in buying estate in large numbers is to make huge profit from them. Therefore, the tenants are relatively more likely to suffer more in their rights under the circumstances of bubble economy. However, the contracts between the tenants and the renters are still legal and valid according to the civil laws for they are signed by the tenants willingly although not sincerely willing to. On the other hand, according to the autonomy of private laws (one of the principles of civil laws), the government has no right to interfere in their lease, thus making it impossible to maintain the tenants’ legal rights in way of civil law which finally puts the rights of them beyond the edge of legal protection.
In response to this issue, the author of this first right to lease from the housing difficulties faced by the start of the phenomenon behind the existence of the nature in this problem - whether the rental right simply by means of civil law is adequate to
protect that right,not a purely civil law on the rights or a compound rights of other
legal property? After analysis, I believe that the rental of housing and its essence is a kind of
