摘 摘 要 专利侵权诉讼救济制度在当今世界知识产权迅猛发展的大环境下的知识产权侵权 诉讼制度中具有重要的稳定功能和平衡作用，专利侵权诉讼作为一种特殊的民事诉讼， 具有自身的特点，专利权客体所具有的科技属性，在该权利被侵犯时才会显现出来，专 利侵权诉讼过程中的侵权行为判定、赔偿数额的计算、侵权证据的收集和侵权证据所 具有的复杂性，这些重要特征都是增加专利侵权诉讼复杂程度和审理难度的根本原因， 因此，专利侵权诉讼救济制度的设计应具有针对性，专利侵权诉讼救济制度的完善， 要贴合专利侵权诉讼救济制度的特性，认识和掌握专利侵权诉讼救济制度的理论，区 别专利侵权诉讼不同于一般民事诉讼救济制度的特殊性，借鉴国际专利侵权诉讼救济 制度的理论与实务，结合国内外专利侵权诉讼救济制度的运行状况，从即发专利侵权行 为的临时措施、诉前证据保全制度、专利侵权损害赔偿制度和专利专家陪审制度等四 个方面进行分析和研究，提出完善我国专利侵权诉讼救济制度的建设性意见。 关键词：专利侵权；诉讼救济；制度构建；完善 jIlllr jIlllrJ／I／[IJl[1lll Ill 10 Y204291 3 Abstract During the quickly development of the Intellectual Property，the Relief System of lawsuit for patent infringement is taking a more and more important part in the world．But before the study of the related questions about lawsuit for patent infringement，the thing that should be sure is lawsuit for patent infringement iS a kind of special lawsuit．It has its unique characters．First，the patent has the technical attribute，and only when the patent infringement happened，it could be showed．Second，lawsuit for patent infringement has complexity．It can be displayed in the judgment of the infringement，in the determination of compensation and in the collection of the evidences．Those characters are the major reasons which increase the difficulty and complexity of lawsuit for patent infringement． So the syStem of lawsuit for patent infringement should have pointed．And the consummation of patent infringement 1awsuit should fit itself characters．After the introduction of the relief system of lawsuit for patent infringement，this article obtains from the patent infringement lawsuit and studies the situation of domestic and foreign．It analyzes from injunction，evidence preservations，compensation and patent expert jury system and considers how to consummate the relief system of lawsuit for patent infringement． Key words：patent infringement：relief of lawsuit：construction of system； consummation 引言引言 引言 引言 在新技术发展、经济一体化和知识产权保护快速协调发展过程中，正视专利侵权 救济制度，认识Trips规定、有关国家规定与我国专利侵权诉讼救济制度的相互影响， 有利于推动专利侵权救济制度的改
