PAGE PAGE 16 家庭财产关系法律结构分析 摘要：家庭财产，包括家庭所有的，以及在生产生活过程中所得的动产及不动产。是家庭共同体中全体人员共同所拥有的财产的总和。根据我国《民法通则》、《婚姻法》及相关司法解释的规定，将家庭财产分为夫妻共同财产、夫妻个人财产、其他家庭成员所有财产、家庭成员共有财产四种。经过多年的发展变更，我国的婚姻家庭制度已经有了本质性的变化，突出了个人的权利，人权得到了极大程度的维护。但是，我国所延续了几千年的封建传统道德伦理中，仍有很大一部分思想根深蒂固，这些思想有的有利于法治社会的构建，推动法治的发展，有的则阻碍了法治民主化，现代化的步伐。根据我国国情，积极弥补漏洞，完善有关婚姻家庭财产的相干法律规定，是目前的当务之急，也是全面贯彻依法治国的必经之路。 关键词：家庭财产制度家庭财产共有约定财产制法定财产制 The analysis of family property relations legal structure Abstract: The family property, including the family owned, and income in the production and life in the process of real estate and real estate.
