PAGE PAGE 18 建筑作品中“审美意义”的判断 摘要 ：现阶段来说，我国著作权的立法对建筑作品的规定少之又少，甚至对它的定义也存在着模糊不清的现象，很多学者对究竟什么样的作品才能称之为具有著作权法所定义的“审美意义”的作品提出了疑问。本文首先从建筑作品本身出发，讨论了建筑作品的概念并将它与著作权法上的一般作品做了比较。本文认为，建筑作品之所以以作品的名义特别为著作权法所保护，是因为它本质上属于作品然而除此之外又具备了其他特性，也就是说，虽然大部分建筑物或构筑物可以称之为作品，但要为著作权所保护，则必须具备其他特性，而建筑作品的这种“特性”就是著作权法所说的“审美意义”的价值所在。所以本文接下来适当的结合了美术作品的表现特征，从审美的角度探讨了建筑作品的特殊性。当然，除了“审美意义”，建筑作品的独创性与一般作品所具备的独创性也是有所区别的，在一定程度上也能体现著作权法意义上的审美价值，所以本文从建筑作品的构成要件特别是建筑作品的独创性也进行阐述和总结。在此基础上，通过对比国内、国际上对建筑作品著作权立法的成果，本文对建筑作品也有了比较全面的解析。 关键词 ：建筑作品；作品；审美意义； Architectural works in the judgment of the aesthetic significance Abstract: At this stage,Chinas copyright legislation for the regulation of architectural works rare.Even there is a vague definition of it, many scholars of exactly what kind of work can be called with a defined by the copyright law has raised questions about the works of aesthetic significance.This article first embarks from the architecture itself, discuss the concept of architectural works and made comparison with general works in copyright law.This paper argues that architectural works are special in the name of work is protected by copyright law, because it essentially belongs to the work in addition also has other features, however, that is to say, although most of the buildings or structures may call it works, but for copyright protection, you must have other features, and architectural works of this kind of feature is what copyright law of the value of the aesthetic significance.So in this paper, the appropriate combination of the performance characteristics of fine arts, from the Angle of aesthetics, discusses the particularity of architectural works.Of course, in addition to the aesthetic significance, general works of architectural works of uniqueness and originality is also different, to a certain extent, also reflects the copyright law in the sense of aesthetic value, so this article from the components of the architectural works especially originality also expounds and summarizes architectu
