摘 要 国内对中世纪英国小城市政治法律特点的探讨尚属空白，在这一方面做出 尝试，不仅具有学术意义，也具有为城市化进程中的中国提供借鉴的现实意义。 真正意义上的中世纪英国小城市应符合在城市性质、人口规模和城市职能 等方面的标准，从而既区别于大中城市，也不同于乡村。对于小城市的英文表 达，笔者通过对各家之言的分析总结，认为“small town”是比较确切的一种 表达。 在各种因素综合作用下，从十一世纪后期开始，英国出现了大量的新兴城 市。这些新兴城市多为私人领主建立的小城市，数量大约在 550 到 600 之间。 在政治层面上，这些小城市具有与其封建领主联系的密切性、浓厚的乡村性、 城市管理职能的不完善性以及市政官员来源的宽泛性等特点。在法律层面上， 这些小城市则具有法权形态上为封建社会的有机组成部分、城市特权享有的非 完整性、商业法规发挥重要作用以及习惯法因素广泛存在等特点。 细致梳理小城市的内在特点，以区别少数大城市与为数众多的小城市，从 而把小城市真正作为中世纪英国城市研究的主体，还原中世纪英国城市的真正 面貌，是国内中世纪英国城市研究的一项迫切任务。把小城市的政治法律特点 的研究作为切入点服务于此目的，正是本文的基本出发点。 【关键词】： 中世纪英国小城市；政治特点；法律特点 4 Abstract Up to now, the domestic studies on the English medieval small town haven’t achieved much success, especially on the domain of the political and law characteristics. Trying in this not only has the academic sense, but also has the realistic sense that China in the urbanization could draw lessons from this. The English medieval small town of the real meaning should first match the standards of a town, then have the population scale and the unique urban functions etc. with these definitions, we can discriminate it from the “city” and “village”. For the English expression of the small town, the author analyzes different opinions about the notion and concludes that “small town” is a more accurate expression. From the late 11ths, towns arised in England in great quantities for various reasons.
