上海交通大学法律硕士学位论文 上海交通大学法律硕士学位论文 浅析《国际贸易术语解释通则 2010》的发展和适用 万方数据 万方数据 《国际贸易术语解释通则 2010》的发展和适用分析 摘 要 自从2001年我国加入世贸组织以来，我国与世界各国之间的贸易成 交额与日俱增。随着世界经济一体化进程的不断推进，国际贸易得到了 进一步的繁荣和发展。国际商会结合贸易和社会发展的实际情况， 2010 年9月正式推出了《国际贸易术语解释通则2010》，新版本于2011年1月1 日正式生效，而《国际贸易术语解释通则2000》已经不能很好的适应新 时代贸易发展。为了使贸易工作者在实际工作中更好理解和正确使用新 版贸易术语，本文概述了贸易术语的发展历程、《通则2010》的新发展 和新适用，分析我国出口企业贸易术语选择过程中的一些问题，以及与 货物销售合同的地位作用的比较，希望能为贸易工作者提供一个更为清 晰的参考。 本文意在通过分析《国际贸易术语解释通则》的新发展新变化，意 义与新涵义，就新旧版本适用中应该注意的问题，探索在此规则下对我 国出口企业产生的影响以及应该如何选择更适合的贸易术语，进一步明 确买卖双方风险划分以及货物交付等问题，帮助我国出口企业在贸易过 程中有效控制费用和风险。 关键字：《国际贸易术语解释通则 2010》 风险转移 贸易术语 我国 出口企业 A RESEARCH ON DEVELOPMENTS AND APPLICATIONS OF INCOTERMS 2010 ABSTRACT Since 2001, China has joined to the WTO, multiple international trade grown rapidly in the world. Our country is facing a critical period of economic transformation and a flourishing domestic commerce development. Incoterms 2000 can’t match the new principles of international trade. So The International Chamber of Commerce launched Incoterms 2010 in September 2010, the incoterms 2010 came into effect on January 1, 2011. In order for trade workers in better understanding of the practical work and the proper use of the new version of Incoterms, this article outlines the history of Incoterms, the new development and application of the general rule for 2010, and analyze trade terms for Chinas export enterprises in the process of selecting some of the issues, as well as comparison of the status of the sale of goods, hoping to provide a clearer reference to trade workers. This paper focuses on the analysis new rules and new applications of international trade terms, and what we should pay more attention in Incoterms 2010. Exploration of Incoterms 2010 and international trade and domestic trade of applies, and through the discussions about new rules, we can advise China’s export enterprises how to select suitable trade term, and prevent potential risks and control costs during trade transaction process
