II II DISCUSSION OF A NUMBER OF ISSUES ON THE INCRIMINATION OF DRUCK DRIVING- ON THE CASE OF MR GAO’S DRUNK DRIVING ABSTRACT Recently, the scenes of the tragedy caused by drunk driving frequently hit the newspapers, which bring many families irreparable damage. Drunk driving has become hated by the people as a road killers who is highly concerned about social parties.Although china has also made a large number laws and regulations to regulate ,it is still not enough to curb the phenomenon of drunk driving.Under this circumstance, on February 25, 2011, the Standing Committee of National Peoples Congress passed the Criminal Law Amendment and the behavior of drunk driving into the scope of the criminal law. Drunk driving into the penalty has profound social background, this paper will from the following four parts to introduce. In the first part, this paper introducing a case, through the analysis of Gao case to put forward the focus of controversy. In the second part, from the thesis of legislative of drunk driving into the penaltyto start,and analysis components of drunk driving into the penalty.With reference to our country current law and make the clear definition for drunk driving behavior. In the third part, Propose the questions of definitions of charge, circumstances of sentencing, penalty constitutions, enforcement procedure .In the fourth part,which mainly discuss the suggestion PAGE PAGE IV of judicial applicable and how to perfect juridical practice.
