西南政 西南政法大学硕士学位论文 醉酒型 醉酒型危险驾驶罪缓刑适用研究 内容摘要 自从《刑法修正案（八）》将醉酒驾驶行为纳入刑法的规制范围，该犯罪行 为无论在理论界还是在实务部门都成为大家关注的热点。在我国当前司法实务 中，由于醉酒驾驶自身的行为特性加之其法定刑较轻，很快醉酒型危险驾驶罪就 成为我国法院适用缓刑最常见的罪名之一。但由于该犯罪是新增犯罪类型，各地 人民法院对该类犯罪的定罪量刑仍然处于探索阶段，在具体的审判过程中，出现 了诸多问题。全国各地的人民法院就本罪的缓刑适用比例与标准差别较大，便是 其中较为突出的问题。笔者尝试运用实证研究与法理分析相结合的方法，对我国 某地区醉酒型危险驾驶罪缓刑适用情况进行研究，以便对该罪的缓刑适用实际情 况有一个直观的认识与了解，从而为规范我国法院就本罪的缓刑适用提出合理可 行的建议。 本文除引言和结语外，正文共分为三个部分： 第一部分是对某地区醉酒型危险驾驶罪缓刑适用的现实情况进行实证考察。 通过部分抽样与完全采样相结合的方法对该地区醉驾缓刑适用情况进行样本采 集，以所收集的数据为蓝本，以图表与案例的方式，统计分析出该地区醉驾缓刑 的具体比例、醉驾缓刑适用的考量因素，同时分析指出该地区在醉驾缓刑适用方 面存在的问题。 第二部分是对醉酒驾驶缘何成为我国目前缓刑适用最常见的罪名之一，从四 个方面对其合理性展开讨论与分析。具体分析视角与理由为：醉酒驾驶行为的社 会危害性及行为人的人身危险性相对较低；醉驾缓刑符合宽严相济的刑事政策； 醉驾缓刑可以缓和醉驾入罪的理论与实务冲突；民众对醉驾缓刑不会有大的抵触 与反对情绪。 第三部分通过前文对醉驾缓刑的统计与分析，尝试对我国醉酒型危险驾驶罪 的缓刑适用提出有益的司法建议。首先提出，应扩大醉驾缓刑的适用比例，并阐 述了理由。其次，具体结合缓刑适用的形式条件与实质条件，就如何规范醉驾缓 刑适用的考量因素提出了自己的看法，并就本罪的缓刑适用提出了具体的司法意 见。最后，对醉驾缓刑适用禁止令时可能涉及的内容进行了相应的探索。 关键词：醉酒驾驶；缓刑比例；缓刑考量因素；缓刑适用司法建议 醉酒型 醉酒型危险驾驶罪缓刑适用研究 西南政 西南政法大学硕士学位论文 1 1 2 2 Abstract Since the Criminal Law Amendment (VIII) will be included in the Criminal Code of drunken driving behavior regulation range,the crime both in theory and in practice all sectors have become the focus of attention.Especially in practice,because the behavior of drunken driving characteristics combined with its own lighter punishment ,it quickly became one of the most common court on charges of probation.But because this is a new type of crime criminal act,conviction and sentencing of the class of crimes court is still in the exploratory stage,in particular trial,there have been many problems.Courts across the country on the difference between probation and standards applicable to the proportion of the larger crime,is one of the more prominent issues.The author attempts to use empirical research and legal analysis of a combination of methods,on an area of the crime of dangerous driving drunk type of probation applicable in-depth study,applicable to the actual situation of the probation sin has an intuitive knowledge and understanding,So as to r
