Therefore, disputes between colleges and students have gradually increased and educational disputes begin appear on public stage. However, there is no present law which has consistent rules governing this kind of disputes. Besides, the academia holds different opinion about the basic problems between colleges and students. In the practice of solving disputes, opinions vary according to whether the court will accept the case, whether colleges will undertake due responsibilities and whether colleges are reasonable and lawful. That’s why sometimes the same case has different judgments. To thoroughly solve disputes between colleges and students, we have to uniform our views of basic problems which mean that we will contract legal relationship of civil law and will be judged by the General Principles of Civil Law and The PRC Contract Law. We should analyses the segment of educational contract and pay attention to contracting fault liability and liability for breach of contract so as to build the authority relief between colleges and students based on the relationship of educational contract
