1 1 内容摘要 当前，我国道路交通安全形势十分严峻，交通事故发生率常年高居世界首位，交通 肇事逃逸案件也呈现出多发的趋势。交通肇事后逃逸行为已经成为近年来刑法理论界争 论的一个焦点问题。本文对相关问题进行了研究，提出修改我国现行刑法关于交通肇事 罪的立法规定，并设置独立的交通肇事逃逸罪的立法构想。 全文由引言、交通肇事后逃逸行为概述、交通肇事后逃逸行为独立犯罪化的必要性、 交通肇事后逃逸行为独立犯罪化的立法构想以及结语五部分构成，全文约两万字。 引言部分，介绍了我国道路交通现状，指出了当前对交通肇事后逃逸行为进行独立 的刑事立法具有重要意义。 交通肇事后逃逸行为概述部分，在介绍国内对交通肇事后逃逸行为的定义并进行简 要评析后，通过对交通肇事后逃逸行为主观和客观要件的分析，得出本文对交通肇事后 逃逸行为的定义。 交通肇事后逃逸行为独立犯罪化的必要性部分，明确了交通肇事后逃逸行为的社会 危害性以及我国现行刑法及相关司法解释存在的问题，指出将交通肇事后逃逸行为独立 犯罪化具有重要意义。 交通肇事后逃逸行为独立犯罪化的立法构想部分，在介绍国内外各种观点之后，提 出本文对现行刑法第 133 条的修改意见以及在刑法中设置交通肇事逃逸罪的立法构想。 结语部分对文章进行简单的小结。 关键词：交通事故；交通肇事罪；交通肇事后逃逸行为；刑事立法 1 1 2 2 Abstract At present, Chinas road traffic safety situation is very serious，the traffic accident formation rate high occupies the world leader year to year,the action of running away after causing traffic accident have also shown multiple trends. The action of running away after causing traffic accident has become a focus of controversy in recent years in criminal law theory field.This article focus on related issues, propose amendments to Chinas current criminal code traffic accident on the crime of legislative provisions and set up a separate legislative crime of hit and run idea.
