I I 摘要 在旅游业蓬勃发展的今天，旅游产业已经成为我国很多地区新的经济增长 点。伴随着旅游产业迅猛发展，土地的集约化利用将更加迅速，旅游开发征地出 现的问题也日益增多。如何妥善处理好旅游用地取得方式、运用有效的征地补偿 方式，从而保护农民土地权益，促进农业和新农村建设可持续发展，同时保持旅 游产业的健康发展是一个重要课题。 我国旅游开发征地补偿主要存在四个方面的问题：补偿标准不合理，补偿范 围不全面；补偿方式单一，补偿后容易产生负面社会效应；失地农民分配到的资 金少，征地补偿费分配混乱；缺乏有效的监督机制和法律保护，容易滋生腐败和 产生纠纷。留地安置方式是解决这些问题的一种科学方法。留地安置是指在征用 土地时，为了使失地农民的生产、生活有长远稳定的保障，在城市规划区内或区 外留出一定比例的土地支持村集体作非农建设使用，让该土地承载生产资料和社 会保障双重功能，能够保障失地农民的长期收益，对被征地农民的社会保障和可 持续发展也有很强的保障作用。留地安置在旅游开发征地中的运用主要包括五个 方面：对旅游开发留地合理位置及规模确定的分析，通过合理调查与科学预测， 确定旅游开发留地的位置及比例，使旅游开发与国民经济发展相协调，确保旅游 业有序发展；结合当地实际情况，确定留地权属，随着经营思路不断变化，更新 和改进留地利用模式；根据旅游项目用地类型确定留地的用途，保证留地整体规 划，确保旅游业顺利开发，同时保护农民的权益；对旅游开发留地安置收益进行 合理分配，应注重利益分配与经营并重的方式，结合被征地村实际，以及失地者 的实际情况，增强收益分配措施的针对性；建立和完善留地安置管理的相关配套 措施，保证留地安置方式顺利开展，以发挥其效用。 关键词：旅游开发；征地补偿；留地安置；可持续发展 II II Abstract At present, the tourism industry is at high development.The tourism industry has become a new economic growth point in many places of our country.With the rapid development of tourism industry, the intensive using of land will be more quickly, and there will be more and more problems of land expropriation. To built the new countryside, it’s an important task to choose a good way for achieving the tourism using land, it’s also an important task to use the effective way of land expropriation compensation to protect farmers land rights and interests, promote the sustainable development of agriculture and new rural construction, while maintaining the healthy development of the tourism industry is an important subject. There are mainly four problems of land expropriation compensation for tourism development in our country: unreasonable compensation standard, compensation scope is not comprehensive; single method for compensation, disputes after compensation; land-lost farmers assigned to less money and land expropriation compensation distribution chaos;social welfare of land expropriation compensation is not stable, easy to corruption and dispute; tourism participation is low; lack of effective supervision mechanism a
