The unfair trade investigation system of intellectual property rights has been established for a long time in the United States， Japan and South Korea. When it comes to cotruct this system in our country， on one hand， we should coordinate the unfair trade investigation system with judicial protection， customs protection and international trade rules. On the other hand， the regulatio of Foreign Trade Law of the P. R. China and Regulation of the P. R. China on the Customs Protection of IP Rights should be adjusted to improve the ititutional basis of the unfair trade of intellectual property rights。 Keyword：intellectual property; fair trade; trade investigation; customs protection; judicial protection; international
