Chinese Journal of Forensic Sciences, 2014 , No .l T，创al No.72 鉴定制度 Forensic System 专家辅助人出庭协助质证实务探讨 邹明理 (西南政法大学司法鉴定中心，重庆 4仪lO31 ) 摘 要:为相关部门实施两法以及制定专家辅助人出庭协助鉴定意见质证实施细则提供参考资料，需要对有专门 知识的人出庭就鉴定人的鉴定意见质证等六个亟待解决的实务问题进行探讨。有专门知识的人法律上不具有唯一性 且未反映其身份和职责特点，宜更名为专家辅助人;对专家辅助人的条件和资格确认提出主张;探讨专家辅助人 出庭质证规则的四个主要问题;对专家辅助人在法庭上向鉴定人提问的内容与方式和参加鉴定意见辩论应掌握的要 点提出若干规范性建议;对专家辅助人法庭质证意见的性质与作用发表评论性意见，并认为专家辅助人应依法进行统 一管理，建立以司法行政机关管理为主、人民法院管理为辅的两结合管理模式。 关键词:有专门知识的人;专家辅助人;鉴定意见质证 中图分类号: DF73;DF72 文献标志码: A doi: 10.3969/j.issn .l671-2072.2014.0 1.002 文章编号: 1671-2072-(2014)01-仪附6-06 The Cross-examination by the Expert Assistant in Court ZOU Ming-li (Forensic Science Center, Southwest Un印ersity 01 Politic a1 Science and La:w, Chongqing 4侃刃， China) Abstract: In order for the imp1ementation of the Civi1 and Criminal Procedure Laws , and to draft the imp1ementation ru1es for the expert assistant appearing in court to assist cross-examination, there are some practical problems to be reso1ved. This paper suggests: the person with specia1ized know1edge shou1d be renamed as the expert assistant, as the original term is not exclusive and does not reflect his identity and 1egal characteristics. The qua1ification of the expe此 assistant is proposed. Four main prob- 1ems on cross-examination by the expert assistant in cou此 are ana1yzed. Some suggestions are a1so given for the content and the way of questioning when the expert assistant cross-examines an appraisa1 expert. It gives comment on the nature and effect of the expert assistant s opinions. The paper ho1ds that the expert assistant shou1d be regu1ated by judicial administrative organs supp1emented by the peop1es courts. Key words: peop1e with
