农村集体经济组织成员资格认定问题研究——以土地补偿款纠纷为例中文摘要农村集体经济组织成员资格的认定，是解决土地补偿款纠纷问题的前提所 在。农村集体经济组织成员资格认定相关内容的探讨，不仅对于解决土地补偿款 纠纷问题有着十分重要的意义，而且对农民经济利益的保障和维系农村社会生活 的稳定发挥着重要的作用。由于我国目前立法的缺失，在实践中成员资格的认定 做法弊端重重。本文试从崔某诉大青村委会土地补偿款纠纷一案入手，对集体经 济组织成员资格认定的相关问题进行探讨。本文运用了分析、对比、归纳等多种手法，对农村集体经济组织成员的相关 问题进行了深入的研究。全文由案例引入，从案例中归纳出有关农村集体经济组 织成员资格认定的争议焦点，并在全文中逐一剖析，包括问题的成因以及解决的 途径。以案例为切入点，又不拘泥于案例。以小见大，以特殊见一般。在分析案 例争议点的同时，提出现实生活中普遍存在的问题，从而提出解决此类问题的普 适方案，而后利用得出的结论，提出对案例的处理意见。文章中归纳出了农村集体经济组织成员资格认定的四个基本原则，分别为综 合考查原则，资格唯一原则，权利平等和充分保护原则，以及意思自治原则；以 这四个基本原则作为农村集体经济组织成员资格认定的基础，再辅以特殊情况下 农村集体经济组织成员资格的认定问题的处理办法，构成了一套较为完备的农村 集体经济组织成员资格的认定体系。最后，提出由案例所引发的思考，呼吁应当 尽快制定农村集体经济组织法，完善管理制度及监督机制，从而更好的解决农村 集体经济组织成员资格的认定问题，为农民利益的切实保障提供法律依据，促进 农村社会经济和谐健康发展。关键词：成员资格 资格认定 农村集体经济组织 土地补偿Studies on The Member’s Qualification ofRural Collective Economic OrganizationAbstractThe qualification of the member in the rural collective economic organization is the premise in solve the disputes of land compensation. The analyzed on the member’s qualification is very important. Not only to solve the disputes of land compensation, but also protecting the farmer ’s economic benefits and the stability of rural life. But at present, the methods in member’s qualification have many disadvantages because of the lack of the legislation. So this article tries to use a case to discuss the member’s qualification.The article uses analysis, contrast, and induction as is method, which deeply researched on the qualification of the member in the rural collective economic organization. The whole article introduced by a real case which induced three dispute points. And analyzed each of them one by one, including the reasons for the formation and the solution. Use the case as the point cut, but not just about the case. From a small see big, from a special see general. Analysis the case dispute meanwhile proposes some questions which exist in the daily life. Then put forward a pervasive solution. At last, give some advices to handle the case by the conclusion.The article
