浅谈现代金融监管体系完善 　　摘要：在经济金融全球化的背景下，金融开放是大势所趋和必然选择。但是由于金融开放直接关系到维护本国金融安全和对本国金融业实施保护，因此各国立法对金融开放都非常慎重。加入WTO之后，我国应当按照GATS和FSA规定的国际义务以及我国的具体承诺通过国内立法予以落实，但必须坚持金融立法的民族性，保证立法适合我国国情。一方面，我国应当顺应国际趋势放松金融管制，促进金融竞争和金融创新，另一方面，应当充分利用GATS序言和第12条的规定，采取适当的限制措施延缓外国金融机构的进入时间，给我国金融业的发展争取时间和机会。 　　关键词：金融监管 体系 完善 　　 　　On the Perfecting of Law System of Modern Financial Supervision System 　　Zhang Yao 　　Abstract:In under the economical financial globalization background,the financial opening is ultimately and chooses inevitably.But because the finance opens relates directly maintains our country finance security and to our country financial industry implementation protection,therefore the various countries’ legislation opens to the finance extremely is all prudent.After joins WTO,our country must defer to GATS and the FSA stipulation international duty as well as our country’s concrete pledge carries out through the domestic legislation,but must persist the financial legislation the national characteristic,guaranteed the legislation suits our country national condition.At the same time,our country must comply with the international tendency relaxation finance control,the promotion finance competition and the financial innovation,on the other hand,must use the GATS preface and the 12th stipulation fully,takes the suitable limit measure to delay the foreign country financial organ to enter the time,the financial industry development strives for the time and the opportunity for our country. 　　Keywords:Financial supervising and managing System Consummation 　　【中图分类号】F832.0【文献标识码】A 【文章编号】1009-9646(2008)11-0121-02 　　 　　1.绪论 　　 　　1.1 金融监管的立法。 　　20世纪，各国金融业无论是在规模上还是在深度上都得到了空前的发展，发生了深刻的变化，特别是自20世纪80年代以来，发展中国家加快了金融改革的步伐，推动本外币自由兑换、开放金融市场、放松外资银行进入的管制；发达国家也相继放松金融监管，进行金融创新。一方面，这些措施改变了整个金融业的面貌，促进了全球金融市场整体效率的提高；另一方面，不断爆发的金融危机，也严重制约了全球经济的发展，不论是发展中国家，还是发达国家，都深受其害。这一切使失去安全与稳定的金融体系显得异常脆弱。 　　进入21世纪，世界经济发生了显著的变化，经济全球化、自由化和区域经济一体化发展迅速，国际市场开放程度大大提高，现代信息技术和现代经济日益融合，经济全球化、自由化的趋势将越来越明显。金融是现代经济的核心，经济全球化、自由化的重要
