论宪法解释宪法学与行政法学专业 论宪法解释 宪法学与行政法学专业 研究生陈飞 指导教师杨泉明 宪法是国家的根本大法，在国家政治、经济、社会生活中具有极其重要的 作用。宪法解释是宪法实施过程中的一个重要环节。它对于维护宪法的权威． 正确地理解宪法，保障宪法的实施具有十分重要的意义。世界各国的宪法解释 制度，大多与违宪审查制度有关，不管违宪审查的主体是普通法院、宪法委员 会还是宪法法院，宪法解释都伴随着宪法诉讼而存在。我国宪法解释的理论研 究和实践都还很不够，宪法解释制度也还很不完善。进一步健全我国的宪法解 释制度，对于加强我国宪法监督、增强宪法的适用性具有十分重要的意义。本 文分三个部分研究宪法解释问题。第一部分，对宪法解释的概念、主体、对象、 原则、方法、效力和界限进行了分析，探讨了宪法解释的一般理论。第二部分， 对宪法解释的历史发展以及西方国家的宪法解释进行了比较研究。第三部分， 考察了我国宪法解释制度的现状，分析了我国宪法解释制度中存在的问题，并 提出了完善我国宪法解释制度的措施。 关键词：宪法解释 宪法监督 现状 完善 0n 0n Constitutional Inter口retation ^bstract：ConstitutiOn is the∞st fund鲫ental law in our country．It plays a Very important role in our p01itical，economic and social 1ife．Constitutional interpretation is an important link in the proceeding of constitutional enforcement．Perfecting the constitutional interpretatiOn system i打China plays an i用pDrta力t ro】8 j力aⅡ)plifying the constitutional supervision system and strengthening the constitutional applicability．，rhis thesis consists of three parts．Part One is the universal theory 0f constitutional interpretation．It contains the concept，subject，obj台ct，principles，methods，validity and 1i珊it of constitutional interpretation．Part Two is the comparative studies of constitutio￡lal interpret8tion．It contains the history of constitutional interpretation and the constitutional interpretation of the west cou rltries．Part Three is the present condition and perfection of the constitutional interDretation in China． Key帕rds：constitutional interpretation constitutional supervision present condition perfection 论宪法解释引言 论宪法解释 引言 宪法解释是宪法实施过程中的～个重要环节。完善我国的宪法解释制度对 于加强我国宪法监督、增强宪法的适用性具有十分重要的意义。2002年12月 4日，胡锦涛在首都各界纪念中华人民共和国宪法公布施行二十周年大会上的 讲话中指出：“全面贯彻实施宪法，必须健全宪法保障制度，确保宪法的实 施。 要抓紧研究和健全宪法监督机制，进一步明确宪法监督程序，使一切 违反宪法的行为都能及时得到纠正。全国人大及其常委会，要从国家和人民的 根本利益出发，在立法过程中充分保障宪法规定的公民的自由和权利；要切实 担负起监督宪法实施的职责，坚决纠正违宪行为；要切实履行解释宪法的职能， 对宪法实旌中的问题作出必要的解释和说明，使宪法的规定更好地得到落实。” 【lj但是，在我国宪法学界，对宪法解释的理论研究还不够深入，我国宪法解释 制度中存在的问题还没有得到充分的重视。笔者认为，其中一个重要原因就是 没有充分认识到宪法解释在宪法监督以及宪法保
