I I 摘 要 摘 要 住房问题是关系民生的重大问题,我国人口众多,住房问题是老百姓的头等大事。 商品房快速发展,同时,一大批中低收入者的住房问题日益突出,公共租赁住房作为国 家住房保障体系中的重要一项,就是旨在解决这部分住房困难人员的住房问题。在公共 租赁住房的实施过程中,公共租赁住房合同对于明确公共租赁住房双方的权利义务,保 障公共租赁住房承租人的权利以及明确公共租赁住房的准入和退出机制都具有重要作 用。 本文以公共租赁住房合同的基本法律理论为切入点,从合同的主体、签订、违约、 解除等方面进行论述,综合国内各省地区的具体不同做法,对公共租赁住房合同的问题 进行细化分析。 文章正文由五部分组成:首先是公共租赁住房合同的概述,主要介绍了公共租赁住 房合同的法律特征、法律性质、立法的价值和功能;其次,文章阐述了公共租赁住房合 同的申请主体,对公共租赁住房合同的主体进行界定;再次,对公共租赁住房合同的订 立过程以及合同的监管进行研究,在分析各地的实际做法的基础上,指出其中的问题, 并提出一些完善意见;最后,总结和论述了公共租赁住房的退出机制。 关键词 公共租赁住房 申请主体 签订程序 监管 退出机制 II II Abstract Abstract The housing problem is a major issue related to the livelihood of the people, Chinas population, housing problem is a top priority for the peoples name. Commercial housing development, at the same time, a large number of low-income housing problems have become increasingly prominent, public rental housing as an important item of national housing security system, is designed to solve the housing problem in this part of the housing difficulties of personnel. In the process of implementation of public rental housing, public rental housing and public rental housing contract to clear the rights and obligations of both parties, the security of public rental housing tenant rights and access to public rental housing and a clear exit mechanism plays an important role in.
