PAGE PAGE 19 表达自由的宪政价值 摘要：国家规定的基本权利中有一项是表达自由权利，国际人权运动也一直为这项人权的保障作出努力。作为一项基本权利，它对当今宪政社会的价值不言而喻，而在现如今，公民的表达自由权利也受到广大重视。我国虽然没有明文出台的人权法，但我国人权法的思想是通过宪法所体现的。因此，作为一个宪政社会，表达自由的价值值得我们探讨。 本文第一部分具体论述分析了表达自由的概念，介绍了什么是表达自由，表达自由的重要意义以及对它的法律准则；第二部分主要介绍宪政社会的含义，什么是宪政社会，宪政社会的构成要素，以及进一步分析宪政社会和表达自由之间的关系；第三部分是本文的重点，具体阐述表达自由产生的宪政价值，具体分为以下几点来论述：对政府，有利于政府遵守宪法，履行政府的职责；对个人，使得公民有较强的权利意识，维护自身权利，获得尊重；对社会，在化解社会纠纷缓解矛盾上有益，处于弱势的群众的利益得到保障，使之不再与主流群体产生隔离感。有利于诚信社会的建立；对民主，有利于公民选举制度的改善，提供了建言献策的渠道；对人权，表达自由作为一项基本人权，促进了国家对人权的保障和努力。 最后，对文章进行了总结论述。结合前三部分的论点进行一个系统的阐述，并给予新的观点。 关键词：表达自由；宪政社会；价值 Express the constitutional value of freedom Abstract: Freedom of expression is a fundamental right and freedom of citizens of the various national constitutions, and is also the basic human rights that the international human rights movement strives for and protects.
