BOT as typical category of PPP is more gradually paid most attention to by worldwide governments since it provides the approach to settle the conflict between the shortage of infrastructure capital and swift development of infrastructures. Government guarantees as the significant and necessary part of BOT projects are the critical factors which determine whether the BOT project succeeds or not. The BOT and its government guarantee legislation in China has already lagged behind most countries over the world, so that abusing and overrunning government guarantees occur during BOT practice. In order to ensure the healthy development of BOT, it is vital to perfect the BOT and hereof government guarantee legislation in China. The study purpose of this dissertation: theoretically analyzes the government guarantees in BOT projects, dissertates its specific contents and relevant practices, based on legislation status quo of other countries, probes into the existing legal barriers and conflicts, further puts forward the meditation for perfecting the BO
