China) Ab stract: Over about a decade s develop ment , the environmental policy of the protection of the environment through Criminal Law of EU is increasingly mature and becomes more influential . The judgment of 13 September 2005 in Case C2176Π03 Commission vs Council clarified the distribution of powers between the first and third pillars as regards provi sions of criminal law and made a significant impact on the environmental policy. The European Council decided to present a new proposal for making a directive on the protection of the environment through criminal law. The new proposal was presented i n February 2007. The environmental policy has important implication to China i n dealing with the environmental crisis through the environmental crime legi slation , the diversity of the penalty measures and the recognition of the integrity and accordance of the legal system , etc .
