人工智能时代种业数据安全的法律逻辑与技术保障

摘要本研究对种业数据的特征及当前的应用情况进行了梳理，指出目前存在的主要风险。针对这些问

题，提出应从法律和技术两个方向同时优化的策略。在法律方面，建议通过明确数据归属、完善相关法律法

规、规范人工智能的使用，来打牢制度基础；在技术层面，则提出通过加密、数据脱敏、智能安全技术应用和建

设完善的数据治理体系，来提升整体防护水平。研究还结合案例，进一步验证了法律与技术协同治理的重要

性。本研究为在人工智能背景下实现种业数据的安全利用和创新应用，提供了理论支撑和实践参考。

AbstractThisstudysortedoutthecharacteristicsandcurrentapplicationofseedindustrydata,andpointedout

themainrisksthatexistatpresent.Inresponsetotheseproblems,strategiesthatshouldbeoptimizedfrombothle-

galandtechnicaldirectionsareproposed.Intermsoflaw,itisrecommendedtolayasolidinstitutionalfoundation

byclarifyingdataownership,improvingrelevantlawsandregulations,andregulatingtheuseofartificialintelli-

gence;intermsoftechnology,itisproposedtoimprovetheoverallprotectionlevelthroughencryption,datade-

sensitization,intelligentsecuritytechnologyapplicationandtheconstructionofasounddatagovernancesystem.

Thestudyalsocombinedwithcasestofurtherverifytheimportanceofcoordinatedgovernanceoflawandtechnol-

ogy.Thisstudyprovidestheoreticalsupportandpracticalreferenceforthesafeuseandinnovativeapplicationof
